In a new suit filed in the state court system Thursday, a Florida woman claims that major candy manufacturer Hershey uses deceptive marketing tactics to encourage consumers to buy its Halloween candy.
According to the suit, the creative choices on Hershey’s packaging made consumers believe the candy inside would have “explicit carved out artistic designs.”
The suit goes on to allege that Hershey’s labels “are materially misleading and numerous consumers have been tricked and misled by the pictures on the products’ packaging.”
The Florida woman is seeking $5 million in damages and proposes the suit’s expansion into a federal class action.
