On Wednesday, fast food chains McDonald’s and Wendy’s won a lawsuit alleging the two companies had conducted false advertising.
The 2022 suit claimed that McDonald’s and Wendy’s used undercooked patties in their ads as “fully cooked burgers tend to shrink and look less appetizing,” resulting in consumers receiving a lesser quantity of food than advertised upon purchase.
However, U.S. District Judge Hector Gonzalez ruled that the two companies’ advertisements “are no different than other companies’ use of visually appealing images to foster positive associations with their products.”
In his ruling, Gonzalez went on to point out that both Wendy’s and McDonald’s listed extensive disclaimers on their websites surrounding the true proportions of the meals.
